Terms of Service

1. Acceptance of Terms

By creating an account, registering a domain, or purchasing any service from HOSTMYWEBCLOUD SOUTH AFRICA (Pty) Ltd ("we," "our," or "us"), you ("Client" or "User") agree to be bound by these Terms of Service. If you do not accept these terms in full, you must refrain from using our services.

2. Account Responsibilities

Users are responsible for maintaining the confidentiality and security of their account credentials and client portal logins:

• Accurately complete contact details and keep contact information updated at all times.
• Ensure passwords and access keys are kept strictly confidential.
• Accept full legal responsibility for all activity occurring under the account.

3. Invoicing, Payments & Renewals

All services are rendered on a pre-paid basis according to the selected billing cycle (Monthly, Semi-Annually, Annually):

• Invoices are generated prior to renewal due dates and must be paid in full to prevent automatic service suspension.
• Domain name renewals are subject to registry grace periods and late redemption fees if allowed to lapse.
• All pricing is quoted in South African Rand (ZAR) or USD unless explicitly stated otherwise.

4. Acceptable Use Policy (AUP)

Our infrastructure must not be utilized for illegal, malicious, or unauthorized activities. Prohibited behavior includes:

• Sending unsolicited bulk commercial email (SPAM) or phishing communications.
• Hosting malware, spyware, unauthorized exploits, or conducting DDoS attacks.
• Storing or distributing copyrighted content without written authority from the rights holder.

5. Service Availability & Backups

While we maintain high availability cloud infrastructure and regular backup systems, Clients remain ultimately responsible for maintaining independent off-site backups of their web applications, emails, and databases.

6. Termination & Suspension

HostMyWebCloud reserves the right to suspend or terminate services immediately, with or without notice, in the event of non-payment, breach of Acceptable Use Policy, or court/regulatory order.

7. Limitation of Liability

To the fullest extent permitted under South African law, HostMyWebCloud South Africa shall not be held liable for any indirect, consequential, or incidental damages, data loss, or loss of revenue arising out of or related to service usage.
